Welcome to Burn Right® Products. These Terms & Conditions (“Terms”) govern your use of BurnRightProducts.com (the “Website”) and purchases of products from Burn Right® Products (“Burn Right,” “we,” “us,” or “our”).

By accessing or using this Website, placing an order, or purchasing a Burn Right product, you agree to these Terms and any policies referenced within them. If you do not agree with these Terms, please do not use the Website or purchase products through it.

1. Website Use

BurnRightProducts.com is provided for lawful personal and commercial use related to learning about and purchasing Burn Right products and services.

You agree not to misuse the Website, interfere with its operation or security, attempt to gain unauthorized access to any portion of it, use it for fraudulent or unlawful purposes, or otherwise use the Website in a manner that could damage Burn Right or another party.

We reserve the right to restrict or terminate access to the Website when we reasonably believe these Terms have been violated.

2. Product Information

We make reasonable efforts to accurately present our products, including descriptions, photographs, dimensions, specifications, features, materials, pricing, and availability.

Because Burn Right products may be improved or updated over time, specifications, components, packaging, appearance, and other product details may change without notice.

Photographs and other visual representations are provided for illustrative purposes. Actual product appearance may vary slightly due to manufacturing variations, product updates, lighting, display settings, or other factors.

We reserve the right to correct typographical errors, inaccuracies, or omissions and to update product information at any time.

3. Orders and Acceptance

Orders may be placed through BurnRightProducts.com or through other purchasing methods currently offered by Burn Right.

Submitting an order and receiving an automated order confirmation does not necessarily constitute final acceptance of the order.

Burn Right reserves the right, at its sole discretion and to the extent permitted by law, to accept, decline, limit, or cancel an order. Reasons may include, but are not limited to:

  • Product availability;
  • Suspected fraud or unauthorized transactions;
  • Payment or billing issues;
  • Incorrect product information or pricing;
  • Shipping restrictions;
  • Errors affecting the Website or ordering system; or
  • Unusually large quantities or suspected resale activity.

If we cancel an order after payment has been collected, we will refund the applicable amount paid for the canceled portion of the order.

4. Payment and Fraud Prevention

Burn Right uses trusted third-party payment providers to process transactions.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges associated with your order.

To protect our customers and Burn Right from fraudulent transactions, we may request additional information to verify payment, identity, billing information, shipping information, or other order details.

We reserve the right to delay or cancel an order when payment or identity verification cannot reasonably be completed.

5. Pricing

Prices displayed on the Website are subject to change without notice.

Once an order has been accepted, subsequent price increases or decreases generally do not affect the price of that completed purchase.

Despite our efforts to maintain accurate information, pricing or product errors may occasionally occur. If we discover an error affecting an order, Burn Right may contact you for additional instructions or cancel the affected order and refund amounts paid for the canceled product.

Promotional pricing, discounts, coupon codes, and special offers may be subject to additional conditions, expiration dates, product exclusions, quantity restrictions, and other limitations communicated with the applicable promotion.

Unless expressly stated otherwise, promotional offers may not be combined.

6. Taxes

Applicable sales, use, and other transaction taxes will be collected when required by law.

The amount charged may depend on factors including the purchaser’s location, shipping destination, type of transaction, and applicable state and local requirements.

Customers remain responsible for any taxes, duties, fees, or similar obligations that are not collected by Burn Right but are otherwise legally owed in connection with their purchase.

7. Shipping and Delivery

We make reasonable efforts to process and ship orders promptly. Processing and delivery dates displayed or communicated by Burn Right are estimates unless expressly stated otherwise.

Delivery times may be affected by carrier delays, weather, holidays, supply conditions, address issues, natural disasters, and circumstances outside Burn Right’s reasonable control.

Customers are responsible for providing complete and accurate shipping information.

Requests to change an address after an order has been processed or shipped may not be possible and may be subject to additional carrier charges.

Burn Right is not responsible for delays resulting from incorrect or incomplete information supplied by the customer.

Shipping promotions, including free shipping when offered, are subject to the terms and geographic limitations stated with the applicable offer and may be modified or discontinued prospectively.

8. Damaged or Missing Shipments

Customers should inspect shipments promptly after delivery.

If an order arrives damaged, incomplete, or appears to have been damaged during transit, please contact Burn Right as soon as reasonably possible and retain the product, packaging, shipping label, and other materials that may be necessary to document a carrier claim.

Burn Right may request photographs, shipping information, or other reasonable documentation before determining an appropriate resolution.

9. Order Changes and Cancellations

Because orders may be processed quickly, we cannot guarantee that an order can be changed or canceled after it has been submitted.

Customers who wish to request a change or cancellation should contact Burn Right as soon as possible.

Once an order has entered fulfillment or has shipped, the purchase may instead be subject to the Burn Right Return & Refund Policy.

10. Returns and Refunds

Returns, refunds, exchanges, cancellations, and related shipping responsibilities are governed by the current Burn Right® Return & Refund Policy, which is incorporated into these Terms by reference.

Customers should review that policy before completing a purchase.

11. Limited Lifetime Warranty

Eligible Burn Right products are covered by the Burn Right® Limited Lifetime Warranty, subject to its terms, limitations, exclusions, claim requirements, and remedies.

The Limited Lifetime Warranty is incorporated into these Terms by reference.

The warranty is non-transferable and applies only to the original purchaser, as further described in the Limited Lifetime Warranty.

12. Safe and Responsible Product Use

Burn Right products are designed for outdoor burning applications and involve fire, high temperatures, hot surfaces, sparks, smoke, and other inherent risks associated with combustion.

Customers and operators are responsible for reading and following all assembly, safety, operating, maintenance, and other instructions provided by Burn Right.

Only responsible adults capable of safely controlling and supervising an outdoor fire should operate Burn Right products.

The customer or operator is responsible for selecting a safe operating location, maintaining appropriate clearances, supervising the product while in use, having appropriate fire-control measures available, and taking reasonable precautions based on surrounding conditions.

Never leave an active fire unattended.

Do not operate a Burn Right product in a manner inconsistent with Burn Right’s instructions or for a purpose for which the product was not designed.

13. Local Laws, Burn Bans, and Regulations

Laws and regulations governing outdoor burning vary significantly by location and may change depending on weather, drought conditions, air-quality restrictions, seasonal requirements, emergency declarations, and local burn bans.

The purchaser and operator are solely responsible for determining whether outdoor burning is lawful at the location and time of use.

Before burning, customers should consult applicable federal, state, county, municipal, fire department, fire district, homeowners association, property-management, and other relevant rules or authorities when appropriate.

Burn Right does not represent or warrant that ownership or use of a Burn Right product makes outdoor burning permissible in every jurisdiction or during any particular burn restriction or burn ban.

Any general information provided by Burn Right regarding burning laws, regulations, or practices is informational only and should not be considered legal authorization to burn.

14. Materials Burned

Customers are responsible for determining which materials may legally and safely be burned in their jurisdiction.

Burn Right products must not be used to burn hazardous, explosive, toxic, prohibited, or otherwise unlawful materials.

Burning materials such as household garbage, plastics, chemicals, treated materials, petroleum products, tires, batteries, aerosol containers, or other restricted materials may be prohibited by law and may create dangerous conditions or harmful emissions.

Always follow applicable laws and Burn Right’s current safety and operating instructions.

15. Product Modification and Misuse

Unauthorized modification, improper assembly, improper installation, misuse, abuse, neglect, use of incompatible components, or operation contrary to Burn Right’s instructions may create hazardous conditions.

Such conduct may also affect warranty eligibility as described in the Burn Right® Limited Lifetime Warranty.

Burn Right is not responsible for damage or injury caused by unauthorized modifications, misuse, unlawful operation, or failure to follow applicable instructions, to the extent permitted by law.

16. Assumption of Inherent Risks

Outdoor burning inherently involves risks that cannot be completely eliminated, including fire, heat, smoke, sparks, embers, property damage, personal injury, and changing environmental conditions.

By choosing to operate a Burn Right product, the user accepts responsibility for exercising reasonable care and following applicable safety instructions and laws.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BURN RIGHT AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE WEBSITE, A PRODUCT, OR THE USE OR MISUSE OF A PRODUCT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BURN RIGHT’S TOTAL LIABILITY ARISING FROM A PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO BURN RIGHT FOR THE PRODUCT GIVING RISE TO THE CLAIM.

These limitations do not apply where prohibited by law or to liability that applicable law does not permit Burn Right to limit or exclude.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Burn Right and its owners, officers, employees, agents, affiliates, and representatives from claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use of the Website, unlawful or unauthorized use of a Burn Right product, material violation of these Terms, or violation of the rights of another party.

This provision does not require you to indemnify Burn Right for conduct for which indemnification cannot lawfully be required.

19. Intellectual Property

Unless otherwise stated, the Website and its contents, including text, product descriptions, photographs, videos, graphics, logos, product names, instructional materials, designs, and other content are owned by or licensed to Burn Right and are protected by applicable intellectual-property laws.

Burn Right® and associated names, logos, branding, and marks may not be used without authorization where such authorization is legally required.

Website content may be viewed and used for personal, non-commercial purposes associated with evaluating or purchasing Burn Right products. It may not be reproduced, republished, distributed, sold, or commercially exploited without permission except as permitted by law.

20. Customer Reviews, Photos, and Submitted Content

If you voluntarily submit a product review, testimonial, photograph, video, comment, or other content to Burn Right for publication or promotional use, you represent that you have the right to provide that content.

Where you expressly authorize Burn Right to use submitted content, you grant Burn Right permission to reproduce, display, publish, and use that content in connection with Burn Right’s Website, marketing, social media, and promotional activities, subject to applicable law and any specific agreement governing the submission.

Burn Right reserves the right not to publish or to remove submitted content where appropriate.

21. Third-Party Services and Links

The Website may contain links to or integrations with third-party websites and services, including payment processors, shipping carriers, social media platforms, and other service providers.

Those services are operated independently and may be subject to their own terms and privacy policies.

Burn Right is not responsible for the content, security, availability, policies, or practices of independent third-party websites or services.

Use of personal information collected through BurnRightProducts.com is governed by the current Burn Right® Privacy Policy, which is incorporated into these Terms by reference.

23. Website Availability

We work to keep BurnRightProducts.com accurate, secure, and available, but we cannot guarantee uninterrupted or error-free access.

The Website may occasionally be unavailable due to maintenance, updates, technical problems, third-party services, security issues, or circumstances outside our reasonable control.

24. Governing Law

These Terms and any dispute arising from them will be governed by the laws of the State of Wisconsin, without regard to its conflict-of-law principles, except where applicable consumer-protection or other laws require otherwise.

Any legal proceeding arising from these Terms shall be brought in a court of competent jurisdiction as permitted by applicable law.

25. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where possible.

The remaining provisions will continue in full force and effect.

26. No Waiver

Burn Right’s failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision in the future.

27. Changes to These Terms

Burn Right may update these Terms from time to time to reflect changes in our business, Website, products, policies, or applicable requirements.

We will post updated Terms on BurnRightProducts.com with a revised “Last Updated” date.

Changes apply prospectively unless otherwise required by law.
