Burn Right® Affiliate Program Agreement

Welcome to the Burn Right® Affiliate Program.

We value the people, businesses, creators, and customers who help introduce others to Burn Right® Products. Our Affiliate Program is designed to reward those referrals while protecting our customers, our affiliates, and the Burn Right® brand.

This Affiliate Program Agreement (“Agreement”) explains the terms that apply when you participate in the Burn Right® Affiliate Program (“Program”).

By applying to, being accepted into, or participating in the Program, you agree to be bound by this Agreement.

1. Affiliate Eligibility & Approval

All affiliate applications are subject to review and approval by Burn Right® Products (“Burn Right,” “we,” “us,” or “our”).

You must provide complete, accurate, and truthful information when applying.

Submitting an application does not guarantee acceptance into the Program. Burn Right reserves the right, at its sole discretion, to approve or reject any application and is not required to provide a reason for its decision.

We may request additional information regarding your website, business, audience, social media presence, or intended promotional methods before approving your application.

If we request additional information and do not receive a response within seven (7) days, we may reject or close the application.

You may reapply at a later date unless Burn Right has specifically notified you otherwise.

2. Affiliate Links & Referral Tracking

Once approved, you will receive access to the Burn Right Affiliate Area and a unique affiliate referral ID.

You may use your approved referral links to direct potential customers to BurnRightProducts.com.

When a potential customer clicks an eligible affiliate link, a tracking cookie is generally placed in the customer’s browser. The standard referral cookie period is 30 days.

For a referral to be properly tracked, the customer generally must complete an eligible purchase using the same browser and device in which the referral was originally tracked before the cookie expires.

Cookies and other tracking technologies are subject to technical limitations. A referral may not be tracked if, for example, the customer:

deletes or blocks cookies;
uses a different browser or device;
completes the purchase after the 30-day tracking period;
uses technology or privacy settings that prevent tracking; or
otherwise completes a transaction in a manner that prevents our affiliate system from identifying the referral.

Burn Right does not guarantee that every referral or customer interaction can or will be tracked.

3. Direct Link Tracking

Burn Right may offer Direct Link Tracking to approved affiliates.

Direct Link Tracking may allow an approved affiliate to link directly from an authorized website to BurnRightProducts.com without including the affiliate referral ID in the visible URL.

Websites submitted for Direct Link Tracking must be owned or controlled by the affiliate and must meet Burn Right’s technical and program requirements, including applicable security requirements.

All Direct Link Tracking requests are subject to approval by Burn Right. We may approve, reject, suspend, or revoke Direct Link Tracking privileges at our sole discretion.

4. Commission Rate

Approved affiliates currently earn a one-time commission of 5% on eligible qualifying purchases attributed to their affiliate account.

Unless Burn Right expressly states otherwise in writing, commissions are calculated on the net eligible product purchase price actually received by Burn Right, after applicable discounts and adjustments.

Commissions are not earned on amounts attributable to:

sales tax or other taxes;
shipping, handling, or delivery charges;
refunds or credits;
canceled orders;
returned merchandise;
chargebacks;
fraudulent transactions; or
other amounts Burn Right determines are not commissionable.

Burn Right may exclude certain products, services, orders, promotions, or transactions from commission eligibility. Any special commission rates or promotional commission structures will be communicated separately when applicable.

5. Qualifying Referrals

A commission is eligible only when Burn Right determines that a legitimate customer purchase was properly attributed to the affiliate through an approved tracking method.

Affiliate tracking information is an important factor in determining referral eligibility, but tracking alone does not guarantee that a commission is owed.

All referrals and commissions are subject to review and approval by Burn Right.

Eligibility for commissions and determination of qualifying referrals are subject to Burn Right’s review and approval at its sole discretion.

Among other things, Burn Right may reject, reverse, adjust, or withhold a commission when a transaction:

is refunded, canceled, returned, or charged back;
is determined to be fraudulent or suspicious;
results from a self-referral;
was generated through prohibited promotional activity;
violates this Agreement;
involves manipulation or attempted manipulation of the affiliate tracking system;
was incorrectly attributed;
duplicates another referral or commission;
results from unauthorized use of discounts, coupons, advertising, or promotional methods; or
otherwise represents activity Burn Right reasonably determines to be abusive, misleading, fraudulent, or inconsistent with the purpose of the Program.

6. Self-Referrals

Affiliates may not earn commissions on their own purchases.

Attempts to circumvent this restriction by using another email address, account, name, payment method, business, household member, or other method may result in the commission being rejected and the affiliate account being suspended or terminated.

The Affiliate Program is intended to reward legitimate referrals of new customer transactions—not to provide affiliates with a personal discount.

7. Returns, Refunds, Cancellations & Chargebacks

Burn Right offers customers applicable return and refund rights under our then-current customer policies.

Affiliate commissions are not considered payable until the applicable 30-day review period has passed and the underlying transaction remains in good standing.

If an eligible purchase is refunded, returned, canceled, disputed, charged back, determined to be fraudulent, or otherwise reversed before a commission is paid, no commission will be owed for that transaction.

If a commission has already been paid on a transaction that is subsequently reversed, Burn Right may deduct the corresponding amount from future affiliate commissions or take other reasonable steps to correct the overpayment.

8. Commission Payments

Approved commissions that are more than 30 days old are generally paid during the first week of each month, provided the affiliate’s approved commission balance has reached the minimum payout threshold.

The minimum payout balance is $50.00 USD.

If your approved balance is below $50.00, the balance will remain in your affiliate account and carry forward until the minimum payout threshold is reached, subject to this Agreement.

There is currently no maximum payout balance.

Affiliate payments are made in U.S. dollars via PayPal.

Affiliates are responsible for maintaining an accurate and active PayPal account and for providing Burn Right with correct payment information.

Burn Right is not responsible for payment delays or failed payments caused by incorrect account information, PayPal restrictions, payment processor issues, or circumstances outside Burn Right’s reasonable control.

Affiliates are responsible for any taxes, reporting obligations, fees, or other financial obligations associated with commissions they receive.

9. FTC Disclosure Requirements

Transparency matters to us.

Affiliates must clearly and conspicuously disclose their financial relationship with Burn Right whenever promoting Burn Right products through affiliate links or other compensated endorsements.

Disclosures must be easy for consumers to notice and understand and should appear close to the affiliate recommendation, endorsement, or link.

An appropriate disclosure may include:

“I may earn a commission if you purchase through this link.”

Simply identifying a link as an “affiliate link” may not always adequately explain the financial relationship to consumers.

For video, livestream, audio, social media, or similar content, affiliates are responsible for providing disclosures in a manner appropriate for that format and in compliance with applicable Federal Trade Commission requirements.

Disclosures must not be hidden at the bottom of a page, buried among hashtags, placed behind a “more” link when doing so makes the disclosure difficult to notice, or otherwise presented in a way that is likely to be overlooked.

Affiliates are responsible for complying with the FTC Endorsement Guides and all other applicable advertising, endorsement, disclosure, and consumer-protection laws and regulations.

Burn Right may review affiliate promotional content for compliance and may request that an affiliate modify or remove content that Burn Right believes does not comply with these requirements.

Failure to make appropriate disclosures may result in suspension or termination from the Program and forfeiture of commissions associated with noncompliant promotional activity.

10. Truthful Product Claims & Advertising

We stand behind Burn Right products, and we expect our affiliates to represent them accurately.

All statements, endorsements, testimonials, comparisons, and product claims made by affiliates must be truthful, accurate, and not misleading.

Affiliates may use product information and claims contained in current Burn Right-approved marketing materials, provided those statements are presented accurately and in their proper context.

Affiliates may not make unauthorized or unsubstantiated claims regarding Burn Right products, including claims concerning:

product safety;
fire prevention;
smoke or emissions;
environmental benefits;
legality or regulatory compliance;
durability or expected product life;
product performance;
warranties or guarantees; or
comparisons with competing products.

Affiliates may express genuine opinions and describe their actual experiences with Burn Right products, but they may not present unsupported opinions or experiences as established facts.

Affiliates may not guarantee that Burn Right products are appropriate, safe, or legal for every customer, location, or application.

Customers remain responsible for following Burn Right product instructions and all applicable local laws, regulations, burn restrictions, permitting requirements, and safety requirements.

When in doubt about a product claim, contact Burn Right before publishing it.

11. Permitted Promotional Activities

We encourage affiliates to promote Burn Right in ways that provide genuine value to potential customers.

Examples of generally permitted promotional activities include:

sharing your affiliate link with customers, clients, friends, followers, or other interested individuals;
writing genuine product reviews;
publishing articles, blog posts, tutorials, or educational content involving Burn Right products;
sharing Burn Right products through social media;
demonstrating your actual experience using Burn Right products;
creating educational videos or other content featuring Burn Right products; and
answering relevant questions online when affiliate links are permitted by the platform and appropriately disclosed.

All promotional activities must comply with this Agreement, applicable laws, and the rules of any website, social network, platform, community, or service being used.

12. Prohibited Promotional Activities

Affiliates may not use promotional methods that Burn Right determines could harm our customers, reputation, brand, advertising efforts, or Affiliate Program.

Prohibited activities include, but are not limited to:

spam or unsolicited bulk messaging;
misleading, deceptive, or false advertising;
cookie stuffing or forced clicks;
fraudulent referrals;
self-referrals;
misleading redirects;
unauthorized coupon or discount promotion;
promotion on coupon-only or discount-code websites without written approval;
misleading claims regarding pricing or availability;
impersonating Burn Right or its employees;
claiming to be an authorized representative, dealer, employee, agent, or partner of Burn Right when you are not;
cloning, copying, framing, or otherwise creating a website that could reasonably be mistaken for an official Burn Right website;
using Burn Right intellectual property in a misleading or unauthorized manner;
distributing malicious software or using deceptive tracking practices;
violating the rules of third-party websites or platforms;
promoting Burn Right through illegal activity; or
engaging in conduct Burn Right reasonably determines could damage the Burn Right brand or customer experience.

Burn Right may investigate suspected violations and may suspend affiliate accounts or commissions while an investigation is pending.

13. Paid Search & Advertising

Unless Burn Right provides prior written approval, affiliates may not use paid search, paid social advertising, display advertising, retargeting, or other paid advertising to directly promote affiliate links in a manner that competes with or could reasonably be confused with Burn Right’s own advertising.

Affiliates may not bid on or purchase advertising using:

Burn Right®;
Burn Right Products®;
BurnRightProducts.com;
Burn Right product names;
misspellings or variations of Burn Right trademarks;
combinations of Burn Right trademarks with words such as “coupon,” “discount,” “sale,” or similar terms; or
other Burn Right-owned trademarks or brand terms.

Affiliates may not represent themselves in paid advertising as Burn Right or create advertisements that could reasonably cause consumers to believe the advertisement was placed directly by Burn Right.

Questions about a proposed advertising campaign should be submitted to Burn Right before the campaign is launched.

14. Email & Electronic Marketing

Affiliates may not use spam or unsolicited commercial electronic messages to promote Burn Right.

Any affiliate who uses email, text messaging, or other electronic marketing methods in connection with the Program is solely responsible for ensuring that those communications comply with the CAN-SPAM Act and all other applicable federal, state, and local marketing, privacy, consent, and consumer-protection requirements.

Affiliates must also comply with the rules and policies of the communication platforms they use.

Burn Right may prohibit an affiliate from using email or other electronic marketing methods if we determine that the affiliate’s activities create legal, reputational, or customer-experience concerns.

15. Burn Right® Intellectual Property

Burn Right owns or controls its trademarks, trade names, logos, product photography, website content, marketing materials, copyrighted works, and other intellectual property.

While you remain an approved affiliate, Burn Right grants you a limited, revocable, non-exclusive, non-transferable license to use Burn Right-approved marketing assets solely for the purpose of promoting Burn Right products through the Affiliate Program.

This permission does not transfer ownership of any Burn Right intellectual property.

Unless specifically authorized in writing, affiliates may not:

modify Burn Right logos or trademarks;
register domains containing Burn Right trademarks or confusingly similar terms;
create social media usernames or accounts that could reasonably appear to be official Burn Right accounts;
register or use Burn Right trademarks as business names;
alter Burn Right product photography in a misleading manner;
sell, sublicense, redistribute, or commercially exploit Burn Right marketing assets; or
imply that Burn Right sponsors, employs, endorses, or operates the affiliate’s business or website.

Upon termination from the Program, your permission to use Burn Right intellectual property under this Agreement immediately ends.

16. Affiliate Websites & Social Media

Affiliate websites, social media accounts, channels, and other promotional properties must be lawful and appropriate for association with the Burn Right brand.

Burn Right may reject or terminate affiliates whose promotional properties contain or promote content involving:

unlawful activity;
pornography or sexually explicit material;
hatred, discrimination, or bigotry;
fraudulent or deceptive practices;
malicious software, hacking, or piracy;
infringement of intellectual property rights;
violence or unlawful dangerous activity; or
other material Burn Right reasonably determines is inconsistent with its brand, customers, or business.

This list is illustrative and not exhaustive.

17. Affiliate Communications

By participating in the Program, you agree that Burn Right may send you communications reasonably related to administration of the Affiliate Program.

These communications may include:

program updates;
commission or payment information;
policy changes;
new products;
approved promotional materials;
affiliate opportunities; and
time-sensitive or embargoed information.

Information specifically identified by Burn Right as confidential, private, or embargoed may not be publicly disclosed until Burn Right authorizes its release.

18. Dormant Affiliate Accounts

We want our affiliates to succeed and encourage active participation in the Program.

An affiliate account may be considered dormant if it generates no tracked visits or other meaningful affiliate activity for six (6) consecutive months.

Burn Right may deactivate dormant accounts at its discretion.

If your account is deactivated for inactivity, you may contact us regarding reactivation or submit a new application.

19. Independent Contractor Relationship

Participation in the Affiliate Program does not create an employment, agency, partnership, franchise, joint venture, fiduciary, or other similar relationship between you and Burn Right.

You participate as an independent contractor.

You have no authority to make commitments, enter into agreements, incur obligations, make warranties, or otherwise act on behalf of Burn Right.

You are responsible for your own business expenses, taxes, insurance, permits, licenses, and legal obligations arising from your affiliate activities.

Nothing in this Agreement guarantees any particular level of referrals, sales, commissions, income, or business opportunity.

20. Suspension & Termination

Either you or Burn Right may end your participation in the Affiliate Program at any time.

Burn Right may suspend or terminate an affiliate account immediately, at its sole discretion, including when we believe an affiliate has:

violated this Agreement;
engaged in fraudulent or suspicious activity;
made misleading or unauthorized product claims;
failed to make required affiliate disclosures;
misused Burn Right intellectual property;
engaged in prohibited advertising;
harmed or potentially harmed Burn Right’s reputation or customers; or
otherwise acted inconsistently with the purposes of the Affiliate Program.

Upon termination, you must discontinue use of your affiliate links and Burn Right marketing materials and stop representing yourself as a Burn Right affiliate.

Legitimate commissions earned from qualifying transactions before termination may remain eligible for payment subject to this Agreement.

Burn Right may reject or forfeit commissions arising from fraud, prohibited promotional activity, violations of this Agreement, or other transactions that do not qualify under the Program.

Sections of this Agreement that by their nature should survive termination—including provisions relating to intellectual property, confidentiality, payment adjustments, indemnification, limitation of liability, and governing law—will remain in effect after termination.

21. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Burn Right, its owners, officers, employees, representatives, affiliates, successors, and assigns from and against third-party claims, liabilities, damages, losses, costs, and reasonable legal expenses arising out of or relating to:

your participation in the Affiliate Program;
your websites, advertisements, communications, or promotional content;
your violation of this Agreement;
your violation of applicable law or regulation;
your infringement or misuse of intellectual property or other third-party rights;
unauthorized or misleading claims made by you regarding Burn Right or its products; or
your negligence, fraud, or willful misconduct.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Burn Right will not be liable to an affiliate for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, loss of data, or loss of goodwill arising from or relating to the Affiliate Program.

Burn Right does not guarantee uninterrupted access to the Affiliate Program, tracking systems, website, Affiliate Area, payment systems, or other technology.

To the fullest extent permitted by applicable law, Burn Right’s aggregate liability arising out of or relating to the Affiliate Program will not exceed the amount of commissions paid or payable to the affiliate during the six (6) months immediately preceding the event giving rise to the claim.

Nothing in this Agreement excludes liability that cannot lawfully be excluded or limited.

23. Changes to the Affiliate Program or Agreement

Burn Right may modify the Affiliate Program, commission rates, eligible products, payment methods, tracking methods, promotional policies, or this Agreement from time to time.

When we make material changes, we may provide notice through the Affiliate Area, by email, by posting an updated Agreement on BurnRightProducts.com, or through another reasonable method.

Unless otherwise stated, changes become effective when posted or on the effective date identified in the notice.

Your continued participation in the Affiliate Program after an updated Agreement becomes effective constitutes acceptance of the revised terms.

If you do not agree with a change, you may discontinue participation in the Program.

24. Governing Law

This Agreement will be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict-of-law principles.

To the extent permitted by applicable law, any legal action arising out of or relating to this Agreement or the Affiliate Program will be brought in a state or federal court of competent jurisdiction located in Wisconsin, and the parties consent to the jurisdiction of those courts.

25. Severability

If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

26. No Waiver

Burn Right’s failure to enforce any provision of this Agreement does not waive its right to enforce that provision or any other provision in the future.

27. Entire Agreement

This Agreement, together with any additional written policies or program requirements expressly incorporated into it, constitutes the entire agreement between you and Burn Right regarding participation in the Affiliate Program and supersedes prior affiliate program terms relating to the same subject matter.

28. Contact Us
